By downloading or using D³ Daily Diet Diary ("D³," "the app"), you agree to these Terms of Use. If you do not agree, do not use the app. These terms govern your use of D³ on any platform on which it is available, including iOS and Android.
D³ Daily Diet Diary is a personal wellness tracking tool. It allows you to log meals, exercise, health notes, and other personal wellness information entirely on your device. D³ is a journaling and awareness tool — it is not a medical device, does not provide medical advice, and is not a substitute for professional healthcare.
D³ does not provide medical diagnoses, treatment recommendations, or clinical guidance of any kind. Nothing in the app — including QUAL scores, S&S budgets, correlations, trends, or any other output — constitutes medical advice.
Always consult a qualified healthcare provider before making changes to your diet, exercise routine, medications, or any other aspect of your health. If you have a medical condition, speak with your doctor before using D³ to track diet or wellness information.
All data you enter in D³ is stored locally on your device. We do not collect, transmit, or have access to any of your personal data. See our Privacy Policy for full details.
You are responsible for your own data. If you delete the app or clear its data, that information is permanently lost. D³ provides a backup feature — we encourage you to use it.
D³ is intended for personal, non-commercial use. You agree not to:
D³ Daily Diet Diary, including its name, design, code, and content, is owned by Jacked Arts L.L.C. All rights are reserved. These terms do not grant you any ownership interest in the app.
D³ is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Jacked Arts L.L.C. does not warrant that the app will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, Jacked Arts L.L.C. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of D³, even if advised of the possibility of such damages. In no event shall our total liability exceed the amount you paid for the app (which is zero, as D³ is free).
You agree to indemnify and hold harmless Jacked Arts L.L.C. and its officers, directors, and agents from any claims, damages, or expenses arising from your use of D³ or violation of these terms.
We may update these Terms of Use from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of D³ after any changes constitutes acceptance of the updated terms.
These Terms are governed by and construed in accordance with the laws of the District of Columbia, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of the District of Columbia.
